Chapter 610 of 'BEEO'

Specified types of buildings must comply with the Energy Efficiency Code.

The Building Energy Efficiency Ordinance, abbreviated as BEEO, was fully implemented on September 21, 2012. Chapter 610 of the Ordinance stipulates that new buildings and existing buildings undergoing "major renovation works" must meet the minimum energy efficiency standards and design requirements set out in the Building Energy Efficiency Code.

Latest developments and achievements

Since the full implementation of the Ordinance in 2012, the Energy Efficiency Code for Buildings and the Energy Audit Code have been first introduced to regulate the energy efficiency of building service installations. These codes will be reviewed regularly to keep them up to date.

The new revised version to be added in 2024 will be fully implemented on August 23, 2025, enhancing energy efficiency standards, with an expected overall improvement of over 20% in energy savings compared to the 2015 version. So far, the Ordinance has covered over 2,300 new buildings and 15,000 major renovation projects for existing buildings, with approximately 2,700 commercial buildings completing their first energy audit.

The three major provisions of the regulations

According to the Ordinance, there are three main requirements:

Developers or owners of newly constructed buildings must ensure that the four main building services installations (air conditioning, lighting, electrical installations, and elevators) comply with the design standards set out in the Code of Practice on Energy Efficiency of Building Services.
During the execution of 'major renovation works', the person in charge must ensure that the four main building services installations meet the design standards.
Owners of commercial buildings must conduct an energy audit every 10 years in accordance with the Energy Audit Code and display a valid 'Energy Audit Form' in a prominent location.

To ensure that the design and construction meet the minimum energy efficiency requirements, developers must submit a 'Stage 1 Declaration' and a 'Stage 2 Declaration' to the Electrical and Mechanical Services Department, and appoint a 'Registered Energy Assessor'. These declarations must be submitted within the specified timeframe to obtain a 'Compliance Registration Certificate'.

According to the Ordinance, there are three main requirements:

Hotels or guesthouses.
Common areas of residential buildings.

Buildings primarily occupied for educational purposes.

Commercial buildings.
Parts of mixed-use buildings that are not used for residential or industrial purposes.
Hotels or guesthouses.

Common areas of industrial buildings.
Buildings primarily occupied for educational purposes.

Buildings primarily used for community purposes (including community halls and social service centers), as well as buildings that serve two or more integrated purposes occupying the above-mentioned locations.
Buildings primarily used for municipal purposes (including markets, cooked food centers, libraries, cultural and recreational centers, and indoor sports halls), and integrated purpose buildings occupying two or more of the above-mentioned locations.
Buildings primarily used for medical and healthcare services (including hospitals, clinics, and rehabilitation centers).
Buildings owned by the government that primarily accommodate people during the execution of any governmental functions.

As long as the building/shop installations comply with the energy regulations, the assessor will issue a "Compliance Form" to the responsible person of the relevant unit or the owner of the public area.

Conduct energy audit form

For owners of the commercial parts of commercial buildings and mixed-use buildings, an energy audit of the central building equipment must be conducted every not more than 10 years.

Exempt buildings

The regulations do not apply to the following situations:

Buildings where the total electrical switch allows a load not exceeding 100 amperes.
Buildings not exceeding 3 stories high, with an area not exceeding 65.03 square meters and a height not exceeding 8.23 meters.
Buildings declared as temporary monuments or historic buildings under the Antiquities and Monuments Ordinance.
Buildings that will no longer exist within 12 months after a specific date as stated by the director.

This regulation aims to promote solid steps towards sustainable development in Hong Kong, to facilitate energy saving and carbon reduction, and to collectively create a better living environment.
